Welcome to StreamJams ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the StreamJams website, mobile application, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement. If you are under 18 years old, you represent that you have your parent or guardian's permission to use the Service and that they have read and agree to these Terms on your behalf.

3. Account Registration

To access certain features of the Service, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account.

You may connect your Twitch account to become a streamer on our platform. By connecting your Twitch account, you authorize us to access and use certain information from your Twitch account in accordance with our Privacy Policy.

4. User Content

The Service allows you to submit, post, or share content, including song requests, comments, and profile information ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with the Service.

You represent and warrant that: (i) you own your User Content or have the right to grant the license described above; (ii) your User Content does not violate the rights of any third party; and (iii) your User Content complies with these Terms and all applicable laws.

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to send unsolicited communications
• Use the Service to collect or store personal data about other users without their consent
• Use the Service for any commercial purpose without our prior written consent

6. Coins and Payments

The Service allows you to purchase virtual currency in the form of "coins" that can be used to request songs and support streamers. All purchases of coins are final and non-refundable, except as required by applicable law or as set forth in our Refund Policy.

Prices for coins are subject to change without notice. We reserve the right to modify, suspend, or discontinue the coin system at any time without notice.

Streamers may earn coins from song requests. We will distribute these earnings in accordance with our payment terms, which may be updated from time to time.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by StreamJams and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our Service, except as necessary for your personal, non-commercial use.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by StreamJams. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that StreamJams shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party websites or services.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

10. Limitation of Liability

In no event shall StreamJams, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
